Meeting minutes: A motion was made by Randy Mackie and seconded by Bill Krick to approve
the October 2010 minutes.

Greg Borgman stated discussion regarding “Roberts Rules” on voting tabled cases had been
clarified by City Clerk office.

EN-100141 (Garage) – 1671 Park St – was removed from agenda permit issued to owner
to repair.


DANGEROUS BUILDING REVIEW CASES

EN-100024 – 741 S. Getty St. – Robert/Jennifer Witham, 741 S. Getty St., Muskegon, MI
49442

Mrs. Loretta Klinesteker POA of Robert Witham arrived after decision had been voted on.

Staff Recommendation: Declare the structure substandard, dangerous and a public nuisance.

Randy Mackie made a motion to accept staff recommendation and was seconded by Jon
Rolewicz.

EN-100126- 299 Sumner – Teresa Smith – 799 Catawba, Muskegon, MI 49442

Ms Teresa Smith was present to represent property.

Anthony Kleibecker reviewed case stating there had not been any contact with owner since the
last meeting. Ms Smith stated she and her mother were working with Pier Point Mortgage to
do a reverse loan. She stated her mother has lived at residence for 20 years and puts her in
position to qualify for this type of loan. They had just gotten credit score back and had phone
number for HBA board could call for verification of loan. She stated her assumption was things
will be in motion to start repairs within 60 days. Greg Borgman said he was soured that no
contact had been made with Inspections to keep them abreast of what was going on. Anthony
Kleibecker asked if Ms Smith had followed up with police and post “no trespassing signs”,
which Ms Smith answered yes she posted but they were quickly torn down. Bill Krick asked if
people were still congregating around property and Ms Smith answered the traffic had died
down. Mr. Krick asked about loan and ownership of home. Ms Smith said she planned to quit

claim property back to her mother. She stated home was originally owned by grandmother
and uncle took possession when grandmother died. She also said the mortgage company
could quit claimed property and process reverse loan at same time. There was some
discussion by board explaining condemnation process indicating there would still be time to get
permits if owner so chooses before case would be taken to City Commission. Ms Smith
apologized for not keeping in contact with Inspection her understanding was that she just
needed to appear at meeting with findings.

Jon Rolewicz made motion to declare the structure substandard, dangerous building and
public nuisance and was seconded by Randy Mackie.

EN-100152 (Garage) – 1679 Park St. – Shawanda Tumblin – 86 Wilmont Dr., Muskegon,
MI 49444

No one was present to represent case but copy of faxed letter was presented to board from
owner indicating plans to demolish garage.

Staff recommendation: Declare the structure dangerous, substandard and a public nuisance.

Motion made by Randy Mackie and seconded by Bill Krick to accept staff recommendation.
