                                  MINUTES
   The Regular Commission Meeting of the City of Muskegon was held at City Hall,
933 Terrace Street, Muskegon, Michigan at 5:30 p.m., Tuesday, October 10, 2000.
   Mayor Nielsen opened the meeting with a prayer after which members of the City
Commission and the members of the public joined in reciting the Pledge of Alle-
giance to the Flag.


ROLL CALL FOR THE REGULAR COMMISSION MEETING
   Present: Mayor Fred J. Nielsen; Vice Mayor Scott Sieradzki; Commissioner John

2000-097    CONSENT AGENDA: Items listed under the Consent Agenda have been

              b. Title Company Bid Proposals.
                 COMMUNITY AND NEIGHBORHOOD SERVICES
     SUMMARY OF REQUEST: Community and Neighborhood Services Department so-
licited bids from local title companies to supply title searches for CDBG and HOME
activity for the 2001 year. The contract term is from October 2000 through September
30, 2001. The City only received two proposals, Harbor Title and Transnation.
   FINANCIAL IMPACT: None
   BUDGET ACTION REQUIRED: None
   STAFF RECOMMENDATION: We recommend Harbor Title be chosen because they
submitted the lowest proposal bid.


               c. SECOND READING. Zoning Ordinance Amendment for Parking Lot
                  Landscaping.               ,
                  PLANNING & ECONOMIC DEVELOPMENT
  SUMMARY OF REQUEST: Request to amend Section 2331 (Landscaping, Fencing,
Walls, Screens and Lighting) of Article XXIII (General Provisions) of the Zoning Ordi-
nance to amend the language regarding landscaping requirements for parking lots.
   FINANCIAL IMPACT: None
   BUDGET ACTION REQUIRED: None
  STAFF RECOOMMENDATION: Staff recommends amendment of the Zoning Ordi-
nance to include the revised language in the section described above.


               d. 2001 Transportation Planning Program Funding.
                  CITY MANAGER
   SUMMARY OF REQUEST: To approve the City's portion of the 2001 Transportation
Planning Program funding for Fiscal Year October 1, 2000 to September 30, 2001.
   FINANCIAL IMPACT: $14630 from the Major Street Fund.
   BUDGET ACTION REQUIRED: None
   STAFF RECOMMENDATION: To approve the request.
   Motion by Commissioner Schweifler, second by Vice Mayor Sieradzki to approve
the Consent Agenda as read.

2000-98     PUBLIC HEARINGS:
               a. Spreading the Special Assessment Roll on: Sidewalk Replacement
                  Program for 2000 (Area E4).
                  ENGINEERING
    SUMMARY OF REQUEST: To hold a public hearing on the spreading of the special
assessment roll for the 2000 Sidewalk Replacement Program and to adopt the resolu-
tion confirming the special assessment roll.
   FINANCIAL IMPACT: A total of $309,918.46 will be assessed against 546 parcels.
   BUDGET ACTION REQUIRED: None at this time.
   STAFF RECOMMENDATION: To approve the special assessment roll and adopt the
resolution.
   The Public Hearing opened at 5:36 p.m. to hear and consider any comments from
the public. Muhammad AI-Shatel gave an overview of the item. Dawn and Dennis
Sanders, 882 Irwin, object. Laura Coffell, 914 E. Dale objects.
  Motion by Commissioner Sieradzki, second by Commissioner Benedict to grant
additional lime to speak to Ms. Coffell.

             Nays: Spataro

Public Hearing at 6:10 p.m.

2000-99     NEW BUSINESS:
               a. Execution of Memorandum of Understanding with the Michigan
                  Department of State Bureau of Driver & Vehicle Records.
                  CIVIL SERVICE
   SUMMARY OF REQUEST: Request that the City Commission grant the Mayor and
Clerk authorization to execute the agreement between the City and the State of
Michigan which governs use of information contained in records obtained from the
State.
   FINANCIAL IMPACT: Nominal set-up fees associated with the State's software.
   BUDGET ACTION REQUIRED: None
  STAFF RECOMMENDATION: To approve this request.
   Motion by Commissioner Spataro, second by Commissioner Schweifler, to grant
the Mayor and Clerk authorization to execute the agreement between the City and
the State of Michigan,

    SUMMARY OF REQUEST: This is to request City Commission concurrence with the
findings of the Housing Board of Appeals that the structures are unsafe, substandard
and public nuisances and that they be demolished within thirty (30) days.
    It is further requested that administration be directed to obtain bids for the demoli-
tion of the structures and that the Mayor and City Clerk be authorized and directed
to execute contracts for demolitions with the lowest responsible bidder(s).
  FINANCIAL 1/v\PACT: ( 1708 Pine Street) The cost of the demolition will be paid with
CDBG funds.
   BUDGET ACTION REQUIRED: ( 1708 Pine Street) None
   STAFF RECOMMENDATION: (1708 Pine Street) This single-family rental unit is located
on Pine Street near E. Larch Avenue. The owner of the property is Jason & Mandy
Coffell.
   A dangerous building inspection was conducted on May 10, 2000. A Notice and
Order was sent to three different locations in Muskegon to the owners on May 12,
2000. Housing Board of Appeals declared the property to be unsafe on August 17,
2000.
   The estimated cost of repairs is $20,000.00.
   FINANCIAL IMPACT: (206 Myrtle) The cost of the demolition will be paid with CDBF
funds.
   BUDGET ACTION REQUIRED: (206 Myrtle) None
   STAFF RECOMMENDATION: (206 Myrtle) This four unit vacant home is located on
Myrtle near Amity Avenue. The owner is Mildred Baker, previously owned by Beatrice
Harvey.
   A dangerous building inspection was conducted on May 10, 2000. A Notice &
Order was sent on May 12, 2000. On May 23, 2000 thirty (30) days was given to com-
plete repairs. Housing Board of Appeals declared it unsafe on August 17, 2000.
   The estimated cost of repairs is $18,000.00 - $20,000.00.
   FINANCIAL IMPACT: (499 Ada) The cost of demolition will be paid with CDBG
funds.
   BUDGET ACTION REQUIRED: (499 Ada) None
   STAFF RECOMMENDATION: (499 Ada) A dangerous building inspection was con-
ducted September 2, 1999. The owner of this property is Lewis Doan. A Notice & Or-
der was mailed out November 3, 1999. At the January 6, 2000 meeting of the Hous-
ing Board of Appeals the structure was found to be unsafe, substandard, a public
nuisance and that the case be sent to the City Commission for concurrence. Im-
provements were started but there has been no sign of current progress.
   The estimated cost of bringing the property into compliance with City Codes is
$20,000.00.
   According to our records no taxes are owed.
   Motion by Commissioner Spataro, second by Commissioner Aslakson to concur
with the Housing Board of Appeals on 1708 Pine Street, 206 Myrtle and 499 Ada.

located on Sanford Street near Forest Avenue. The owner is Tonie Moore.
    A dangerous building inspection was conducted on March 24, 2000. A Notice &
Order was sent out on March 28, 2000. Mortgage companies were notified on April
24, 2000 upon receipt of the title search. On July 6, 2000 the Housing Board of Ap-
peals declared the property unsafe.
   The estimated cost of repairs is $25,000.00.
   Motion by Commissioner Spataro, second by Commissioner Aslakson to concur
with the Housing Board of Appeals.

   STAFF RECOMMENDATION: (1109 Pine Street) This two-unit rental is located on Pine
Street near Diana Avenue. The owner of the property is Orville Bass.
   This property has been going through the Dangerous Building Process since 1988.
A dangerous building inspection was conducted on April 7, 1998. A Notice & Order
was sent on April 15, 2000. A permit was issued on May 30, 2000. Housing Board of
Appeals declared it unsafe on September 7, 2000.
   The estimated cost of repairs is $12,000.00.
   Vice Mayor Sieradzki and Commissioner Benedict were excused at 7:03 p.m.
   Motion by Commissioner Spataro, second by Commissioner Aslakson to concur
with the Housing Board of Appeals.

   STAFF RECOMMENDATION: (438 Isabella Avenue) This single family rental unit and
garage is located on Isabella near Wood Street. The property is owned by Citi Finan-
cial Bank in Tampa, FL., previously owned by Irwin Dubey.
    A dangerous building inspection report was conducted on July 6, 2000. A Notice
& Order was mailed on July 11, 2000. At the September 7, 2000 meeting of the Hous-
ing Board of Appeals, the structure was found to be unsafe, substandard and a pub-
lic nuisance. There has been no sign of any progress of repairs and no contact from
the owner.
   Estimated cost to repair is $15,000 - $20,000.
   Motion by Commissioner Spataro, second by Commissioner Aslakson to concur
with the Housing Boord of Appeals.

   STAFF RECOMMENDATION: (555 Amity Avenue) This occupied single-family unit is
located on Amity Avenue near Scott Street. The owners are Joseph and Christina
Anderson.
  A dangerous building inspection was conducted on September 10, 1997. Has
been to Housing Board of Appeals many times and have had delays and postpone-
ments since September 1997. On February 3, 2000 the owner was given two weeks to
complete repairs.
   Estimated cost to repair is $15,000.00.
  Vice Mayor Sieradzki returned at 7:46 p.m.
   Motion by Commissioner Aslakson, second by Commissioner Schweifler to concur
with the Housing Board of Appeals but to delay action for 60 days.

demolished.

        Dear City Clerk:

        Pursuant to your letter of September 15, 2000 and my conversation with Oneata Bailey on
        September 25, 2000, Transnation Title submits the following proposed bid.

        Transnation proposes to use the form that is currently being used by the City of Muskegon
        Inspection Department to set forth the information required by the Department of Community &
        Neighborhood Services. (A copy is attached for your review.) Your department will complete the
        top portion of the form to submit to Transnation for completion. Transnation will examine the
        records of the Muskegon County Register of Deeds as to the property described on the form.
        Transnation will complete the form, furnishing to the City the Liber, page and date of the last
        recorded deed showing the name and address of the grantor and grantee; open liens and
        mortgages, which will include land contracts, State and Federal tax liens; assignments; divorce
        liens; bankruptcy and fixture filings; the date through which we examined the records; and the
        name ·of the person who did the title search.

        Upon request, Transnation will do a tax history on the furnished description. The tax history will
        include a report of any delinquent taxes at the county or, if not delinquent, the prior years tax
        amount, as well as, the current or delinquent City tax amounts. The tax history will not include
        special assessment, invoices or infractions and water bills.

        The cost for the title search will be $50.00. An additional fee of$25.00 will include a tax report.
        Your department will be billed directly and payment would be expected within 60 days after
        receipt of the report. The tax report is optional. You may ask that the person making the request
        bring in evidence that their tax bills are current by submitting to you a copy of their last three or
        four tax bills.

        The request can be faxed, picked up or E-mailed. Our fax number is 739-0932 with an E-mail
        address of [email protected]. Completed search(s) will be delivered to your office.

THE CITY COMMISSION OF THE CITY OF MUSKEGON HEREBY ORDAINS:

         landscaped with one (I) shade canopy tree and three (3) shrubs for every eight (8) parking spaces.
         Canopy trees shall be a minimum of twelve (12) feet in height with a minimum caliper of2
         inches at four and one-half (4 ½) feet above the ground.

         The Zoning Administrator may allow the substitution of bump-outs or other landscaping

Hearing; Case 2000-38: Request for an amendment to the Zoning Ordinance to make
changes to the requirements for landscaping in parking lots.

BACKGROUND
This is a proposed change to the Landscaping regulations that were adopted in April. The
current language reads as follows:

        8.   Parking Lot Landscaping: Parking lots exceeding 5,000 square feet (including all parking
             spaces, lanes, drives and other areas devoted to vehicular use) shall be landscaped with
             one landscape island of at least 180 square feet and one (I) shade canopy tree and three
             (3) shrubs for every eight (8) parking spaces. Canopy trees shall be a minimum of twelve
             (12) feet in height with a minimum caliper of 2 inches at four and one-half (4 ½) feet
             above the ground. The width of landscape islands, bump-outs or swales shall be a
             minimum of three (3) feet.

Staffs concern with the current language is that the requirement is the same (one landscape
island), whether the parking lot is 5,001 square feet, or 500,001 square feet. Staff would
prefer to use a sliding scale (which was the original intent) based on the size of the lot and
number of spaces, to require additional landscape islands.

Also, staff feels that there are times when landscape islands are not practical, and bump-outs
may work just as well. As this really can't be determined, except on a case-by-case basis,
depending on the layout of the specific parking area, staff is proposing some flexibility in the
language to allow the Zoning Administrator to determine whether bump-outs or other
landscaping elements would be a better choice in specific cases.

             lanes, drives and other areas devoted to vehicular use) shall be landscaped with at least one (1)

             180 square feet in size, with a minimum width ofthree (3) feet. Landscape islands shall be

RECITALS:

1.     The City Commission determined to create a special assessment district covering the
       properties set forth in Exhibit A attached to this resolution on March 14, 2000, at the
       first hearing.

2.     The City has reviewed the special assessment roll which purports to levy a special
       assessment in the said district, levying on each property a portion of the cost which has
       been determined to be appropriate, considering the improvements, the benefit to the
       assessed properties, and the policies of the City.

3.     The City Commission has received final bids for the construction and/or installation of
       the improvements and determines it to be fair and reasonable.

4.     The City Commission has heard all objections to the roll filed before or at the hearing.

THEREFORE, BE IT RESOLVED:

I.     That the special assessment roll submitted by the Board of Assessors is hereby approved.

2.     That the assessments levied may be made in installments as follows: annual installments
       over ten ( I 0) years. Any assessment which is paid in installments shall carry interest at
       the rate of 5.00% per annum to be paid in addition to the principal payments on the
       special assessment.

                     Special Assessment Payment Options
Property owners in the City of Muskegon who are being specially assessed for street, sidewalk or other public
improvements may pay their assessment in the following ways:
/. Lump Sum Payment in Fuf/
Assessments may be paid in full within sixty (60) days of the confirmation of the special assessment roll
without interest.

1/. lnstaf/ment Payments
Assessments not paid within the first sixty (60) days may be paid in installments over several years as follows:

       Street and Afley Assessments - Ten (10) years equal annual principal payments. For example, if the
       amount of your assessment is $850.00, you will be billed $85.00 per year plus applicable interest as
       described below.

       Driveway, Sidewalk, and Approach Assessments - Ten (10) years equal annual principal payments
       plus applicable interest as described below.

       Interest- Simple interest is charged at the rate of 5.00% per year unless the City has borrowed money
       to complete the project for which you are assessed and has pledged you assessments for repayment of
       the borrowed money. In such cases, the interest you are charged is equal to the interest rate the City
       must pay on the borrowed money plus 1.00%.

Ill. Special Assessment Deferral (Low Income Seniors and Disabled Persons)
To qualify for a special assessment deferral you or your spouse (if jointly owned) must:

   •   Be 65 years or older or be totally or permanently disabled.

   •   Have been a Michigan resident for five (5) years or more and have owned and occupied the homestead
       being assessed for five (5) years or more.                                        ··

   •   Be a citizen of the U.S.

   •   Have a total household income not in excess of $16,823.00

   •   Have a special assessment of $300.00 or more.

Under this program the State of Michigan will pay the entire balance owing of the special assessment,
including delinquent, current, and further installments. At the time of payment a lien will be recorded on your
property in favor of the State of Michigan. Repayment to the State must be made at the time the property is

Assessor's Office at 724-6708 or the City Treasurer's Office at 724-6720. Applications may be obtained at
the Muskegon County Equalization Office in the Muskegon County building or City of Muskegon Assessor's
Office in City Hall.

V. Additional Special Assessment Payment Assistance
Qualified low and moderate income homeowners who are being assessed may be eligible for payment
assistance through the City of Muskegon Community Development Block Grant (CDBG) Program. Assistance
from this program will be available to the extent that funds are available. To obtain further information and
determine whether you are eligible, contact the Community and Neighborhood Services Department at

                            SIDEWALK REPLACEMENT PROGRAM FOR 2000

                The location of the special assessment district and the properties to be assessed are:

      AREA E-4 BOUNDED BY EVANSTON AVENUE TO THE NORTH, GETTY TO THE WEST
                    AND THE CITY LIMITS TO THE EAST AND SOUTH.

PLEASE TAKE NOTICE that a hearing to confirm the special assessment roll shall be held in the City of
Muskegon Commission Chambers on October 10, 2000 at 5:30 p.m.

At the time set for the hearing the City Commission will examine and determine whether to approve the special
assessment roll which has been prepared and submitted for the purpose of said hearing and for examination by
those persons to be assessed. The special assessment roll is on file and may be examined during regular business
hours at the City Engineer's office between 8:00 a.m. and 5:00 p.m. on weekdays, except holidays.

YOU ARE HEREBY NOTIFIED THAT YOU HAVE A RIGHT TO PROTEST YOUR ASSESSMENT
EITHER IN WRITING OR IN PERSON AT THE HEARING. IF THE SPECIAL ASSESSMENT ROLL IS

                      For The 2000 Sidewalk Replacement Program

                    Location and Description of Properties to be Assessed:
                           See Exhibit A attached to this resolution


RECITALS:

     A hearing has been held on March 14, 2000 at 5:30 o'clock p.m. at the City
     Commission Chambers. Notice was given by mail and publication as required by
     Jaw.

2.   That estimates of costs of the project, a feasibility report and valuation and benefit
     information are on file with the City and have been reviewed for this hearing.

3.   At the hearing held March 14, 2000, there were 4. 25 % objections by the owners of the
     properties in the district registered at the hearing either in writing received before or at the
     hearing or by owners or agents present at the hearing, and the Commission has considered
     the advisability of proceeding with the project.

FINDINGS:

1.   The City Commission has examined the estimates of cost to construct the project including
     all assessable expenses and determines them to be reasonable.

2.   The City Commission has considered the value of the properties to be assessed and the
     value of the benefit to be received by each properties proposed to be assessed in the district
     after the improvements have been made. The City Commission determines that the
     assessments of costs of the City project will enhance the value of the properties to be
     assessed in an amount at least equivalent to the assessment and that the improvement
     thereby constitutes a benefit to the properties.

THEREFORE, BE IT RESOLVED:

1.   The City Commission hereby declares a special assessment district to include the
     properties set forth in Exhibit A attached to this resolution.
  2.    The City Commission determines to proceed with the improvements as set forth in the
        engineer's survey, inspection, recommendation and estimates of costs, and directs the City
        Engineer to proceed with project design, preparation of specifications and the bidding
        process. If appropriate and if bonds are to be sold for the purposes of financing the
        improvements, the Finance Department shall prepare plans for financing including
        submission of application to the Michigan Department of Treasury and the beginning of
        bond proceedings.

 3.     The City Commission hereby appoints a Board of Assessors consisting of City
        Commissioners Asl akson              and Spataro                 and the City Assessor
        who are hereby directed to prepare an assessment roll. Assessments shall be made upon
        actual work preformed.

· 4.    Based on the City's Special Assessment policy and preliminary estimates it is expected that
        approximately 100% of the cost of the improvement will be paid by special assessments.

  5.    Upon submission of the special assessment roll, the City staff is hereby directed to notify
        all owners and persons interested in properties to be assessed of the hearing at which the
        City Commission will consider confirmation of the special assessment roll.

SUMMARY OF REQUEST:             Request that City Commission grant the

                                State of Michigan which governs use of
                                information contained in records obtained
                                from the State.




FINANCIAL IMPACT:               Nominal set-up fees associated with the
                                State's software.

  the Secretary of State in Lansing expressing our desire to arrange for designated individuals of the Civil
  Service staff to have access to subject records which are maintained in an electronic format by the
  State of Michigan.

  Their response was in the form of a Memorandum of Understanding (MOU) to be executed between
  their office and mine. I have reviewed the MOU (attached), and received input from our MIS
  department. I am satisfied that we will not have any problems honoring and abiding by the terms and
  conditions set forth in the Memorandum. Consequently, I would like to execute said memorandum
  immediately. I believe I am in the capacity of an "appropriate official" which they require. Signature on
  the MOU signifies agreement with all of its terms and conditions.

  The only unfulfilled requirement is for us to agree to adopt and enforce a written policy which provides
  for the disciplining of any of our employees who use or release data obtained under the MOU for
  personal use or private gain. We have ninety (90) days after execution of the MOU to furnish the State
  a copy of said Policy. We received a copy of their "Unauthorized Release of Information Policy" to use
  as a guideline if we need it to develop our policy. I will draft and staff (circulate) a policy to cover this
  next week.

  I will need to designate the Civil Service Personnel who will be authorized to use this system on a form
  also provided by the State.

  Having this system in place furthers our efforts to maximize the use of the technology available and will
  reduce processing time for drivers' information from the current 2-3 weeks to approximately 5 minutes.
  Beyond nominal administrative setup costs, we do not expect this to have any financial impact on the
  City's budget.

An IBM PC, or compatible, owned by your agency, with terminal emulation software furnished by the
Department of State, must be used as the terminal equipment in your office. Internet access/service
must be available on this equipment.

I have enclosed a Memorandum of Understanding which must be signed by your organization's chief
administrator or another appropriate official, signifying agreement with all terms and conditions. Upon
return of the signed agreement and following its formal execution, the Department of State's data
security administrator will contact you regarding connectivity, passwords, and appropriate user codes.

In addition, please complete a copy of the enclosed MISOS System Access Request form for each
employee you wish to have record access. You may duplicate the form as needed. If you have any

Muskegon City employees have an on going opportunity to access confidential
information or records that are only available to the general public on a limited
review or purchase basis. Much of the information processed by City employees
is confidential, and its release is governed by law; for example, driver record and
vehicle registration information. Employees must not divulge confidential
information contained in the records and files obtained by any department,
except to other employees who may need such information in connection with
their duties and to authorize parties in accordance with proper department
procedures.

If an employee is approached to provide information inappropriately, the
employee must refuse to release the requested information and refer the
requester to the employee's immediate supervisor.

In addition to being a violation of State statues, it is a very serious offense ( with
penalty as severe as dismissal), for an employee to release or use for personal
purposes, confidential information obtained in the course of employment. Any
employee who inappropriately releases, or uses for personal reasons confidential
information obtained pursuant to the memorandum of understanding (MOU)
between the City and the State of Michigan's Bureau of Driver and Vehicle
Records is subject to disciplinary action in accordance with established policies
and procedures.

                            FOR ELECTRONIC ACCESS TO DRIVER, VEHICLE AND RELATED RECORDS

          PURPOSE. The purpose of this Memorandum of Understanding (MoU) is to document the terms and conditions
          under which the above-named governmental agency (the AGENCY) will obtain electronic access to specified driver,
          vehicle and/or related records maintained by the Michigan Department of State (the DEPARTMENT), for the
          purpose of carrying out the AGENCY's functions.

          ACCESS AND USE. Pursuant to the terms and conditions of this MoU, the DEPARTMENT agrees to furnish the
          AGENCY with records and information from the DEPARTMENT's driver, vehicle and related databases, and to
          permit the AGENCY, either directly or through a data processing Subcontractor, to have electronic access to
          electronically maintained, specified driver, vehicle and related records. The AGENCY agrees to use the records and
          information obtained under this MoU solely for the purpose of carrying out the AGENCY's functions.

          AVAILABILITY OF SERVICE. The DEPARTMENT reserves the right to schedule the hours and duration of the
          availability of electronic inquiry access for the AGENCY. However, the DEPARTMENT cannot guarantee (and is
          not guaranteeing) continuous availability during scheduled times, due to the possibility of hardware, software, or
          other system-related failures.

          DISCLAIMERS. It is understood that the DEPARTMENT cannot guarantee (and is not guaranteeing) the accuracy
          of the data in its electronic files, It is further understood that tl1e DEPARTMENT cannot guarantee (and is not
          guaranteeing) the accuracy of any data transmitted over common carrier lines. It is also understood and agreed that
          the DEPARTMENT is not indemnifying the AGENCY, nor will it be liable to the AGENCY, for any data, computer
          programs, job streams, or other similar items which have become delayed, lost, damaged, or destroyed as a result of
          an electronic exchange or transmission of data under this MoU.

          METHOD OF ACCESS. The AGENCY agrees to access the DEPARTMENT's electronic driver, vehicle and
          related records only via a method or in a manner approved by the DEPARTMENT. From time to time, the
          DEPARTMENT will specify exact procedures to be followed by the AGENCY in all phases of inquiry and related
          operations.

          SUBCONTRACTING OF DATA PROCESSING SERVICES. It is understood that the AGENCY may perform
          its own data processing services or may subcontract with a private firm or another governmental agency for the
          performance of any data processing required to implement this MoU. If the AGENCY uses the services of a data
          processing Subcontractor, then the AGENCY agrees to execute a written agreement with the firm or other
          governmental agency, which serves as its data processing Subcontractor. The agreement shall prescribe the
          Subcontractor's responsibilities with respect to furnishing information to the AGENCY and shall also include the
          provisions set forth in the Employee Competence, Security of Data, Employee Discipline Policy, Use Restrictions,
          and Driver Privacy Compliance paragraphs of this MoU. The AGENCY shall furnish a copy of the agreement to
          the DEPARTMENT, at no cost to the DEPARTMENT, within 30 days after the agreement takes effect, or prior to
          the effective date of this MoU if an agreement is already in effect. Failure to comply with this paragraph is grounds
          for termination of this MoU.

          YEAR 2000 COlvIPLIANCE. The AGENCY warrants that all software used by the AGENCY, or the AGENCY's
          data processing Subcontractor, includes (or shall include) sufficient design and performance capability so that the

DEPARTMENT will not, due to date-oriented processing, experience any software abnormality and/or the
ge11eration of incorrect results from the use of the software in connection with the business of the DEPARTMENT.

INSTALLATION, USE AND RELATED FEES. The AGENCY agrees to pay all installation and use fees, if any.
The AGENCY further agrees to purchase or be responsible for obtaining the terminal(s) or PC(s) utilized in
accessing the DEPARTMENT's data files, to acquire any software deemed necessary by the DEPARTMENT, and to
reimburse the DEPARTMENT for any necessary and reasonable start-up progrannning expenses associated solely
with the AGENCY's accessing of driver, vehicle and related records.

LOOK-UP AND SERVICE FEES. Inasmuch as the AGENCY is a public body, the DEPARTMENT agrees not to
charge the AGENCY the standard record look-up fee of $6.55 per record, which is billed to the DEPARTMENT's
private commercial customers; provided that the AGENCY does not assess the DEPARTMENT for receiving copies
of the AGENCY's records. Nevertheless, the AGENCY accepts responsibility for paying all service fees imposed
by the Michigan Department of Management and Budget, Michigan Information Processing Center (MIPC), in
connection with receiving records accessed by the AGENCY under this MoU.

EMPLOYEE COMPETENCE.                 The AGENCY agrees that any AGENCY employee or data processing
Subcontractor employee who is authorized to access driver, vehicle and related records under this MoU will be
adequately trained to access such records, is competent to perform that task, and will conduct each record inquiry in
accordance with the standards of technical competency that are generally recognized in the data service industry.

SECURITY OF DATA. The AGENCY agrees to implement the following security requirements whenever and
wherever records and/or information obtained under this MoU is accessed, stored, or disseminated:
1. Use software and hardware, which is technologically adequate to prevent unauthorized access to the
   information.
2. Establish operational programs to prohibit unauthorized inquiries from any terminal or other access site.
3. Institute operational programs to detect unauthorized attempts to penetrate the DEPARTMENT's system of
   electronic records.
4. Provide for the physical security of the AGENCY's computer system, with procedures and devices designed to
   protect against the theft of records and information.
5. Furnish the DEPARTMENT with a separate MISOS System Access Request form (or other equivalent form) for
   each AGENCY employee or Subcontractor employee who directly accesses driver, vehicle, or related records
   under the provisions of this MoU.

EMPLOYEE DISCIPLINE POLICY. The AGENCY agrees to adopt and enforce a written personnel policy
which provides for the disciplining of any AGENCY employee who uses or releases a driver, vehicle, or related
record obtained under this MoU for personal reasons or private gain. The AGENCY's policy shall be the equivalent
of, or more severe than, the DEPARTMENT's Unauthorized Release of Information Policy, which is attached as
Rider A. The AGENCY also agrees to furnish a copy of its policy to tl1e DEPARTMENT, at no cost to the
DEPARTMENT, within 90 days after execution of this MoU. The AGENCY further agrees to require its data
processing Subcontractor, if any, to also adopt a similar policy. Failure to adopt and enforce an appropriate policy
of employee discipline is grounds for termination of this MoU.

USE RESTRICTIONS. The AGENCY agrees that the DEPARTMENT's electronic files will be used only for the
purpose of carrying out the AGENCY's functions, including driver employment activity, and for no other purpose.
The AGENCY further agrees not to provide any copy of the information received under this MoU to a private
citizen, partnership, corporation or association, for a purpose unrelated to official business. The AGENCY further
agrees not to resell records obtained from the DEPARTMENT under this MoU.                 Failure to comply with this
paragraph is grounds for termination of this MoU.

DRIVER PRIVACY COMPLIANCE. By executing this MoU, tl1e AGENCY certifies that the driver, vehicle, and
related records obtained by the AGENCY under this MoU will be used in compliance with the federal Driver
Privacy Protection Act of 1994 (18 USC 2721 et seq.) and related Michigan driver privacy legislation (e.g., 1997 PAs
100 and 101; MCL 257.208c and 257.208d). The AGENCY understands that the willful, unauthorized use or improper

redisclosure of personal infmmation obtained under this MoU could subject an individual to criminal penalties imposed
by law (e.g., MCL 257.903). Failure to comply with this paragraph is grounds for termination of this MoU.

RELATIONSHIP. It is understood that this MoU is not intended to and will not in any way make the AGENCY an
agent or independent contractor of the DEPARTMENT.

NON-EXCLUSIVITY. It is understood that this MoU is not intended to give the AGENCY the exclusive right to
access the DEPARTMENT's driver, vehicle and related records electronically. It is further understood that nothing in
this MoU should be construed to prohibit the DEPARTMENT from furnishing driver, vehicle and related records to
other governmental agencies, or from selling such records to private businesses and citizens by any means whatsoever.

NOTIFICATIONS. Any notice or notification which either party may desire or may be required to deliver to the other
party under this MoU will be deemed validly delivered to and received by the addressee, if delivered personally on the
date of actual delivery, if transmitted by facsimile h·ansmission on the date of transmission, if mailed by express mail on
the date of certified receipt, or if maile.d via first class mail on the fifth business day after mailing. All notices and
notifications shall be transmitted to the addresses and facsimile telephone numbers specified in the introductory
captions to this MoU.

CHANGE OF ADDRESS. Either party shall advise the other party by written notification of any change of address or
change of voice or facsimile telephone number of the party giving notice. Upon receipt of this notice) the new address
or number shall be deemed the official address or number of the party giving notice.

A!VlENDivillNTS. The AGENCY acknowledges that the DEPARTMENT may amend the te1ms and conditions of this
IvfoU from time to time in order to accommodate changes in the law, changes in the services or infmmation furnished,
or for other reasons deemed appropriate by the DEPARTMENT. The DEPARTMENT agrees to notify the AGENCY
in writing of the contents of any amendment The AGENCY agrees that the practice of continuing to access
information electronically after receipt of notification of any amendment constitutes the AGENCY's acceptance of the
amendment.

WAIVERS. No provision of this MoU will be deemed to have been waived by the DEPARTMENT, unless the waiver
is set forth in a written notification received by the AGENCY.

ACCESS AUTHORIZATIONS AND AUDITS. At the DEPARTMENT's request, the AGENCY shall provide the
DEPARTMENT, at no cost to the DEPARTMENT, with such access authorizations as are necessary to enable the
DEPARTMENT's personnel to verify compliance witl1 this MoU. In addition, the AGENCY shall permit the
DEPARTMENT to audit such records of the AGENCY as are necessary in the opinion of the DEPARTMENT to
conduct an effective audit verifying compliance with this MoU.

CAJ'ICELLATION. It is agreed that either the DEPARTMENT or the AGENCY may cancel this MoU for any reason
by giving written notice of cancellation to the other party not less than 30 calendar days prior to the date of
cancellation.

TERMINATION. In the event of a material breach of this MoU, the DEPARTMENT may immediately terminate this
MoU by giving the AGENCY written notice of termination. It is expressly understood that any violation of the
patagraphs on Employee Competence, Security of Data, Employee Discipline Policy, Use Restrictions, and Driver
Privacy Compliance are material breaches of this MoU and are grounds for termination. Termination will be effective
upon the AGENCY's receipt of the wiitten notice of tennination.

ENTIRE AGREEMENT. This MoU and its rider, along with any written notices, notifications and amendments
executed later and pursuant to this MoU, constitute the entirety of the terms and conditions of this MoU. It is further
understood that no oral representation made by any employee, officer or agent of the DEPARTMENT shall have any
force or effect whatsoever as a term or condition of this MoU.

EFFECTIVE DATE. This MoU is effective as of the second date written below.

TERM OF AGREEMENT. This MoU shall remain in effect until canceled or terminated.

This is to request City Commission concurrence with the findings of
the Housing Board of Appeals that the structure located at 1708 Pine
Street is unsafe, substandard and a public nuisance and that it be
demolished within thirty (30) days.

It is further requested that administration be directed to obtain bids for
the demolition of the structure and that the Mayor and City Clerk be
authorized and directed to execute a contract for demolition with the
lowest responsible bidder.

            APPEALS FINDING OF FACT AND ORDER FOR 499
            ADA.


SUMMARY OF REQUEST:

This is to request City Commission concurrence with the findings of
the Housing Board of Appeals that the structure located at 499 ADA
is unsafe, substandard and a public nuisance and that it be
demolished within thirty (30) days.

It is further requested that administration be directed to obtain bids for
the demolition of the structure and that the Mayor and City Clerk be
authorized and directed to execute a contract for demolition with the
lowest responsible bidder.

FINANCIAL IMPACT:

The cost of demolition will be paid with CDBG funds.

BUDGET ACTION REQUIRED:

None

STAFF RECOMMENDATION:

A dangerous building inspection was conducted September 2, 1999.
The owner of this property is Lewis Doan. A Notice and Order was
mailed out 11/3/99. At the January 6, 2000 meeting of the Housing
Board of Appeals the structure was found to be unsafe, substandard,
a public nuisance and that the case be sent to the City Commission
for concurrence. Improvements were started but there has been no
sign of current progress.
The estimated cost of bringing the property into compliance with City
Codes is $20,000.00

According to our records no taxes are owed.

Attached are copies of the minutes of the January 6, 2000 meeting of
the Housing Board of Appeals and the finding of fact and order of the
board dated 1/11 /00/

COMMISSION RECOMMENDATION:

           Mr. and Mrs. Doan attended the meeting. They explained that they wanted to move into
           499 Ada after it is livable. They live at 500 Ada at the present time. Bob Grabinski said
           that there have been no repairs thus far. Mr. Doan wanted to know what makes it
           dangerous. They had put up some boards and painted. They just use it for storage. Bob
           Grabinski explained that a building couldn't be boarded for longer than 180 days. The
           Board needs to know what they intend to do with it. It needs work done to roof, eaves,
           fascia, missing siding, etc. Do they intend to hire someone to do the work? Mr. Doan
           said that Leonard Burgess was going to do the work. He was reminded to make sure that
           he is a licensed contractor. It was explained to Mr. and Mrs. Doan that the Board would
           consider it substandard, unsafe, a public nuisance and forward to the City Commission
           for concurrence but that if the proper permits were taken out and work progressed, it
           would not be sent on to the City Commission. They were also reminded that if work
           stops for a period of time, it would be sent on to the City Commission for concurrence.
           Greg Borgman said that Mr. and Mrs. Doan should work closely with the inspectors on
           what needs to be done. Greg Borgman made a motion, supported by Fred Nielsen, to

HBA declared the property unsafe.
