Brief Summary: Staff is seeking approval of the listed amendments to West Urban Properties
Development Agreement for the PILOT Infill Housing Program.
Detailed Summary: The City has previously entered into an agreement with West Urban Properties
to construct 100 homes for rental and potential owner-occupied stock in our residential
neighborhoods. Some of the lots in the exhibit have been requested by other builders for some time
and were inadvertently included in this agreement. We have worked out an agreement with West
Urban for them to remove these lots from their development agreement by increasing their ARP
agreement allotment, and by working with them to identify lots to add to the PILOT with clear title to
ensure that they can fulfill their obligations in this agreement.
This item proposes to remove 266 Meeking, 270 Meeking, 280 Meeking, 290 Meeking, 1057
Leonard, 1067 Leonard, 1077 Leonard, 1087 Leonard, 527 Herrick, and 530 Herrick from the
approved PILOT Agreement, and add 2043 Dowd , 2051 Dowd, 2065 Dowd, 2075 Dowd, 2250 Dowd,
2358 Dowd, 846 Wilson, and 1256 Fifth Street. Staff may return with additional lots to add to this
agreement exhibit as we clear title and assess buildability.

FIRST AlvIBND:rvIENT TO PILOT DEVELOPMENT AGREEMENT AND
PARCEL PURCHASE AGREEMENT
This First Amendment between City of Muskegon ("City"), 933 Terrace, Muskegon,
Michigan, 49440 and West Urban Properties, LLC ("West Urban"), 3265 Walker Ave. Suite D,
Grand Rapids, Michigan 49544 has been entered into pursuant to the following terms:
Recitals
A. City and West Urban executed a PILOT Development Agreement and a Parcel
Purchase Agreement dated November 1, 2020. Attached to both documents was a list of addresses
of properties owned by City to be purchased and developed by West Urban.
B. City and West Urban have agreed to delete 11 parcels from the list of parcels to be
purchased and developed by West Urban, and to add 8 parcels.
THEREFORE, THE PARTIES AGREE AS FOLLOWS:
1. Exhibit A of the PILOT Development Agreement and Exhibit A of the
Parcel Purchase Agreement shall be revised to DELETE 266 Meeking, 270 Meeking,
280 Meeking, 290 Meeking, 1057 Leonard, 1067 Leonard, 1077 Leonard, 1087 Leonard,
1639 Fifth Street, 527 Herrick, and 530 Herrick, and will be revised to ADD 2043 Dowd,
2051 Dowd, 2065 Dowd, 2075 Dowd, 2250 Dowd, 2358 Dowd, 846 Wilson, and 1256
Fifth Street.
2. City and West Urban agree that the attached Exhibit A, which provides
the addresses of property subject to this agreement, supersedes any prior agreement as to
properties subject to this agreement.
3. As to all other respects, the Contract for Housing Exemption shall
continue in force as ifrestated herein.
