In consideration for my use of the fitness room, I, being of sound mind and legal age, hereby agree and acknowledge the following: 1. There are certain risks of physical injury, including death, and damage to personal property related to my use of the fitness room, and hereby assume the full risk of any injuries and expenses, which I, or my personal property, may sustain while using the fitness room. Use of the fitness room is at my own risk and is not a condition of employment. 2. In consideration for being permitted to use the fitness room, and with full knowledge of the risks described above, I agree to waive any claim of liability that may arise out of any acts or omissions of the City, or any claim of liability I may have against the City that may arise while using the fitness room. 3. I agree to indemnify and hold harmless the City from all actions, claims, demands, damages, losses, or expenses of any kind that I, my heirs, or assigns may now or at any time thereafter have against the City arising out of or related to my use of the fitness room including those caused by the negligence, default, or misconduct. 4. The fitness room is monitored at all times. My use of the fitness room constitutes acknowledgment and acceptance of video monitoring of the fitness room. 5. Failure to follow fitness room rules, posted guidelines, or City policies may result in suspension or permanent revocation of fitness room access. I understand the City may modify fitness room rules at any time. The City reserves the right to restrict or terminate an employee’s access at any time for safety, operational, or policy compliance reasons. Violations may also be subject to applicable City disciplinary procedures. Damage to equipment or the fitness room caused by misuse, negligence, or intentional acts may result in loss of access, and I may be responsible for the cost of repair or replacement. 6. All use of the fitness room is voluntary and unsupervised, and equipment must be used safely and only as intended. I certify that I am physically capable of safely using the fitness room. I agree to exercise reasonable care when using City equipment and facilities and agree to seek guidance if I do not know how to safely operate equipment. 7. The City is not responsible for lost, stolen, or damaged personal property brought into or left in the fitness room. I am solely responsible for securing and protecting my personal belongings. 8. My use of the fitness room is voluntary and outside the course and scope of my employment with the City. I understand that use is not a condition of employment, not part of my job duties, and is not compensated work time. I acknowledge and agree that any injury, illness, or other harm arising from or related to my use of the fitness room is not work-related and is not covered by workers’ compensation benefits. I agree not to make or pursue any workers’ compensation claim against the City arising out of or related to my use of the fitness room. This provision does not apply to employees who are required or expressly authorized in advance, in writing, to use the fitness room during compensated work time as part of their job duties. I have read this Waiver, including the assumption of risk, waiver of liability, and indemnity agreement, fully understand its terms, and understand that I am giving up substantial rights, including my right to sue. I acknowledge that I am signing this Agreement freely and voluntarily, and intend my signature to be a complete and unconditional release of all liability to the greatest extent allowed by law. If any provision of this agreement is unenforceable, the remaining provisions shall remain in full force and effect.Signature(Required)
